Yes but at least you would get a warning. On another SI Brinker board, I made a post and was kicked off. My post was on topic and my post didn't include an insult or discussion of competing products. So, each board has leeway on how it is run and nobody should expect perfection.

As for mutual funds and ETFs, I know of only one case where he did not, at the time a newsletter recommendation was made, make it clear whether the recommendation would be included in his model portfolios, so it can't really be described as a pattern of behavior.

Think about a random number generator that was set to say "head" or "tails" to guess the coin toss before each Monday Night Football game. Next think of a radio show where the owner of the random number generator only let callers on the air that praised his correct calls. I am sure that radio show commentator could sell predictions from that random number generator for coin tosses for quite a bit of money to his audience that likes to bet on football games. No different that Brinker and his "Marketimer off the books advice."
