What I get from this is that our regulators are stuck in status quo mode. They get 100's of 1000's of email tips from every day people that result in almost all going into the circular file, along with the important "tips" such as those on Madoff. How often do you see a threatening post about "reporting this to the SEC?" So you can see the scope of the problem vs. the resources. So many focus on penny ante stuff that the real scams are ignored.

Most of the issues could be "cured" with understandable common sense legislation and actual enforcement. Start from scratch. Bring our markets into the 21st century. Elminate the old ways. MM's that actually provide service with technology geared to fair markets. Equal access to information. Board of directors that are truly independent. Pay packages that make sense and provide strict incentives for long term success of the entity. Strict enforcement of fiduciary duties of management and BODirectors.

Etc, etc. Change the system, level the playing field, and, above all, provide for trades to really settle, eliminate the counterfeiting of shares, the front running by moneyed interests and the hiding of information.
