ORDER * * * * * * * * * * *
This matter is before the court upon the motion of the defendant, James N. Turek, for further enlargement of time to answer the complaint. R. 16. The plaintiff, the Securities and Exchange Commission (“SEC”), objects to the motion. R. 17. The court, having reviewed the record and being otherwise sufficiently advised, will deny the motion.
Mr. Turek requests a second sixty-day extension of time to answer the complaint. In his first request for an extension of time, Mr. Turek claimed that he needed more time to engage counsel. R. 11. Now, he states that he has chosen counsel but needs additional time to obtain funds to pay the attorney’s retainer. R.16. Because Mr. Turek has known about this matter for approximately ninety days, the court finds that he has had sufficient time to obtain counsel.
Accordingly,
IT IS ORDERED that the motion of the defendant, James N. Turek, [R. 16] is DENIED.
IT IS FURTHER ORDERED that the defendant shall file his answer to the complaint within twenty (20) days from the date of entry of this order.
