Yes. The ITU-T will avoid enacting a standard that contains patented code IF that code is not made available on a non-discrimatory basis. 3Com's pricing for licensing Townshend's code was quite reasonable, almost negligible for any significant player. I think their move to get the license from Townshend was in response to the bullshit pulled by Motorola when they dropped their longstanding suit (v.34) against Rockwell and filed a new suit against US Robotics when the K56Flex consortium was formed. Politics and rhetoric, pure and simple. Now, everyone has something everyone else needs, and they will wind up cross-licensing after enriching all of the attorneys.

Rockwell is in no hurry for a v.pcm standard, since they can't even get their act together between their own OEMs using K56Flex (which, I might add, is just as proprietary as x2). They currently have a technical disadvantage, so time (delay) is their friend. 3Com would like nothing better than to see a standard, since Rockwell OEMs would fall flat on their face trying to implement it within their patchwork quilt consortium.
