I wasn't addressing all of the problems. Derivatives seem to have been the accelerant once all of the other crap was piled on.

Agree with your other points, but not insane tort law. It's the same tort law that's been around for centuries. The only real insanity in tort law are most of the asbestos cases (and that's being changed for the better in some states). The insurance companies and the republican party successfully won the issue by shouting the loudest. "Tort reform" in many states has swung the pendulum way back to the right.
