I want our cops, FBI, and other security apparatus to have a court order with good justification to conduct invasive investigations. FISA took that right away.

Listen.. when individuals residing in the US, but calling overseas (or using overseas networks) come up on the radar as a link to terrorist activity, it's VERY important not to "spook" them and have them run for the bushes. We want to know who they are in contact with in order to develop an association matrix of the overall network.

Intelligence collection and analysis is NOT law enforcement. It's mission is to operate to safeguard our national security. There is liaison with FBI (which has primary domestic counter-intelligence jurisdiction) at the appropriate time, but the primary consideration is to prevent and interdict terrorist activities, and the second priority is to break down and neutralize the network.

FISA exists for the purpose of acting as a legal gatekeeper against over-exuberant intelligence collection. And I have no doubt that abuses might occur from time to time, but they are very few.

I've played around in those circles while I was in Iraq. I have an inkling about the legal hurdles that must be vaulted before we're permitted to collect on US citizens (or resident aliens).
