I see your comparison but there is a big difference - Jim Crow laws were created with the purpose of exclusion or harm and as a reaction to emancipation and the civil war. The "ban" on gay marriage was just considered normal and not expressly written into law. Now if you're talking about the constitutional ban on gay marriage attempt - spot on.
