It was't that ominous as it sounded. Neomedia passsed successfully the USPTO re-examination and deemed that their core patent '048 as patentable. What EFF did was to shoot themselves in the foot. How poetic. This USPTO has actually helped strengthened Neomedia's core patent '048 and clarified even further by reducing the 95 claims down to 89. This, ironically also, greatly increases the likelihood of being upheld in a court of law as well. And Scanbuy knows how damaging this fruitless effort was with the EFF's behalf to try the USPTO route.

EFF showed great immaturity by submitted supposedly 3 references of a "prior art" but it turned it had nothing to do with Neomedia's patent in the first place. The 3rd reference was the straw that broke the camel's back seeing the silliness of EFF's efforts and the USPTO granted Neomedia their patent '048.

Again. Neomedia WON the USPTO re-examination on their core '048 patent. All pending claims of the patent under reexamination have been indicated to be patentable by the U.S. Patent and Trademark Office (PTO).
