I've always held that there is no grey area in doctrine whether it is scriptural, governmental, or contractual. Ideas of principle may be absolute, however every circumstance is unique and every person brings a unique perspective to circumstance.

Torture may be defined in the absolute. It not only defines the level of suffering a victim may experience but it has a context which goes beyond the normal suffering of incarceration and interrogation by an enemy. That circumstance in and of itself may involve unbearable suffering for some people.

I have withheld my personal opinion of waterboarding because the consequences of judging it one way or the other involves personal responsibility for your stand. I am comfortable, however, in noting that the DOJs judgment establishes a legal basis. Something you have also proclaimed.
