Waterboarding is not clearly included as you claimed then. It is an interpretation. I've already said I can see how it might be interpreted that way if put to the test. You keep arguing with me as if I have stated someplace that waterboarding could not be interpreted that way. I have never argued that. Nor have I said your argument is necessarily right or wrong, except as a legal basis for charging Bush with something; in which case it is inapplicable.

The interpretation of any policy or doctrine is subject to the perspectives of those looking at it while considering the circumstance of application. However, if you want a legal basis for validating a perspective you must use the legal authority having jurisdiction. In the case you are presenting, that jurisdiction falls under the DOJ as you proudly proclaimed yesterday.
