Failure to supervise. A brokerage firm's failure to adequately
supervise its broker may also result in liability for the brokerage firm.
Federal securities laws and NASD and Exchange rules require
brokerage firms to reasonably supervise their brokers for the purpose
of preventing violations of the rules and regulations of the securities
industry. In order to satisfy its obligations, a brokerage firm must show
not only that they had in place supervisory and compliance rules and
procedures, but also that they effectively implemented and enforced
their compliance rules and procedures so as to diligently supervise the
activities of the brokers. Related to the cause of action for failure of
supervision is the secondary liability of a brokerage firm for the acts of
their agents under the statutory "control person" provisions and the
common law doctrine of respondeat superior holding the employer
liable for the wrongful acts of the employee acting within the scope of
employment .http://www.securitieslaw.com/causesofaction.html

will understand as I did, why there could be no numbers. As it was explained to me by
Gregory Garge, they are leasing machines with dbExpress loaded on it. That means a
monthly revenue stream to IBM as well as Concepts. It is more valuable although we
will not see the pop that the company had the street anticipating. This is a big
agreement with monies to just begin flowing.<<<<<<

>>>>>DJ left out the nice quote from Gregory Garbe, IBM Availability Services unit.
Talked
with him at length. I am satisfied that the company will turn around. It isn't happening
right away, the money will flow. I trust what Perot is doing at the company to clean it
up more so, than the thieves that WERE in control. They did fleece the public, but
things have changed and it will take some time before the public will SEE it, no rumors,
no smoke, no mirror, just solid proof will change it.

Looking for more from IBM.<<<<<<<<

Maybe, this little company has more than the general public is aware. Garbe is a
veteran in this industry and loves this product. Don't you think that he knows when a
great program comes along, you jump on it!!<<<<<<<

>>>>>>This is the next step beyond SQL. Garbe intimates this. When we get the
IBM release

>>>>>>When Richard West releases his lengthy report, I believe that he will lay out
exactly
what he expects in '97. I believe this is a very profitable number. This company is on
the verge of making "real" money. Profits from DbExpress are already coming in the
4th Q from the deal cut in August with IBM, but unfortunately we won't see these
numbers until 90 days after the year is closed and audited.<<<<<<
exchange2000.com

=============
>>>>>>Here's some more to "sleep" on, old friends and newcomers. Cavannino,
Garbe and
Perot all have something in common. Three blue letters - "IBM". It's an alumni club,
folks. We do well to ride on their coattails as they strive to make their individual
fortunes. IBM provided needed credibility for their "seed" this year. Next year, the
farmers will all be working for themselves... just in time to reap the "harvest". Funny
how that works out... Comprende?

I've got to be careful, so I'll be cryptic here. There's good stuff evolving with a large
telecommunications company and people will be flying to London.

On another front, a large order that will generate BIG revenues went down about 3
weeks ago but the company leak masters are being particulary tight-lipped on this one.
More than one rumor oracle confirms about 200k units on that one sale ALONE.
Even if that number's wrong, it's not too far off. This company's in the black, folks -
just like Stephanie said. No news allows accumulation at low prices before the run-up
staging begins next month. That's why the accumulation pattern.>>>>>>
exchange2000.com
=============
>>>>>>IBM is only passing on $3 out of $5 dollars monthly in the Availability
Services division
from leased product they are placing. I can only assume that this full purchase was
done for quite a lot more, but no where near even $100 a copy. If these numbers were
better than this, we might still not see them in print as the company's legal department
has matters keeping them busy over projectiions in the past. No numbers will we see,
just good agreements with impressive companies.

As Ingrid posted earlier, a new name overseas will emerge and the street will really like
this. Forget the losers that are bailing at this time of year and just line your pockets with
their failed investigations. This IS the last time you can get 'em cheap. The future is
quite bright. And even though there are those that would wish that I would keep silent
(even though they haven't) I say these things to those that will listen to encourage them
that this product is awesome and will "be the next step beyond SQL".>>>>>

=================

So there you have it Rensho, begining in June 1996 through June 1997 when the LIE
of the IBM
revenue was finally laid to rest with the 10-K and the 1st Qtr 10-Q The IBm Rumor
and the IBM
PRESS RELEASE were used to keep everyone in line either buying or holding.
WHY?? Could it be
that even though you were at one time told that the company would never need to raise
capitol again
using Reg S or debentures that ALL DURING THIS PERIOD OF ONE YEAR
THAT IS
EXACTLY WHAT THEY WERE IN FACT DOING. During that period the
outstanding shares
increased to almost double the previous amount. IS THERE ANY BENEFIT TO
THAT
AGENDA? IF YOU PIN DOWN EXISTING SHAREHOLDERS WITH A
BUNCH OF
CRAP, SO THAT THEY WON'T BE SELLING, AND MAYBE THEY WILL
BUY MORE
SHARES, DURING A TIME WHEN SOMEBODY WANTS TO SELL A LOT
OF SHARES
isn't it much easier to sell the shares you want to unload on the market??????

The bottom line is that the IBM CRAP kept everyone here excited while they waited
for this turn
arround revenue to show up on the books and when the books appeared LATE you
were told that
there is no appreciable revenue from dbEXPRESS. AND ISN'T IT CUTE THAT
FIRST YOU
ARE TOLD TO CALL GARBE THE BIG SHOT AT IBM WHO WOULD
CONFIRM THESE
"RECORD SALES" AND THEN GARBE GOES TO WORK FOR CCEE FOUR
MONTHS
LATER. What kind of ethics and honesty is this folks????

FOOL ME ONCE SHAME ON ME!!!
FOOL ME MORE THAN ONCE-- SHAME ON SOMEBODY ELSE---
UNLESS "ME" IS A
TOTAL IDIOT.
