They are not worried about CO2, just nitrogen oxides, mercury emissions and a couple others. You would have to go to the State of Washington's Dept of Ecology to see what their permit requires of the plant. I know that it has changed over time.

Edit:

I do know that they have been having problems with particulate emissions too.
