Microsoft countersues Sun Micro news.com

My, the Microsoft legal eagles are earning their bucks these days.

Microsoft denied Sun's claims and countersued Sun for breach of contract, breach of the covenant of good faith and fair dealing, and unfair competition. The software giant said Sun repeatedly failed to live up to its obligations under an agreement the two companies forged on March 11, 1996.

Is the irony here intentional ore unintentional?

The countersuit specifies that Sun failed to deliver technology that passes Sun's own test suites and that runs on the Microsoft Reference Implementation. The suit also says Sun did not provide a public set of test suites, as required by the agreement.

So, Sun didn't deliver stuff that runs on Microsoft's Java, which is being engineered to not run Sun's stuff? Or something like that. All I can say is what I said at the beginning, I hope Sun has good lawyers, because Microsoft does, and has never been afraid to use them. I hope the current actions will at least keep Microsoft's lawyers busy enough to stop the petty harrassment of disrespectful web sites for a while.

Microsoft's suit against Sun alleges intentional interference with prospective advantage, said Microsoft. It also alleges unfair business practices for repeated false statements about the compatibility and desirability of Microsoft's products and Microsoft's rights under the agreement.

Oh no, intentional interference with prospective advantage! The humanity!
