They followed due process and did things according to legal guidelines. The review of relevant laws by the authorities approved their plan of action. You can make a law specific to waterboarding but if you do it would be a new law. Do we charge people for crimes when the law wasn't created until years later? Judges and juries interpret the law, not the perpetrators and their lawyers.
