Haven't had a chance to read this yet, but here's a new USSC
decision regarding indecency on public airwarves:

Under the Administrative Procedure Act, Federal Communications Commission orders stating that expletive use of certain words may be actionable and its finding that two broadcasts were actionably indecent were not arbitrary and capricious. Agency policy that a lack of repetition weighs against a finding of indecency but is not a safe harbor also did not violate the act.
