But ownership of air is not claimed by the public like ownership of the broadcast spectrum is.

(And... if you think that exclusive rights to broadcast can't be SOLD... then maybe the American people ought to be paying the telephone companies back their tens-to-hundreds of BILLIONS of Dollars back right about now! 'Cause... I assume they would not want us to KEEP THEIR MONEY if they knew they could have exclusive rights to the spectrum for FREE! :-)
