The judge came to his own conclusions.

Based on the agreement the government created. It wasn't as if the proceedings went in to court with nothing established, and everything was created and decided by the judge. At most he modified the agreement a bit, but its essentially the initial position rammed through by the government. If the government had created some very different agreement the judge would likely have gone along with that. For example if the government got all or even most of the creditors to agree that the normal pattern of senior creditors getting priority would be followed, its almost inconceivable that the judge would toss the agreement and force the senior creditors to defer to the junior.
