It's pretty clearly with established racial/sexual/religious/ethnic insults that represent bigotry that ordinary equal opportunity laws penalize, that qualifies as a specific hate motive, as opposed to assaulting someone in a simple robbery, domestic dispute or typical bar fight.

Perhaps - but in the case of religious types that oppose gay lifestyles (in general) but do not hate gays and simply believe they're living in sin or possessed by evil according to "god" - if they were to be involved in an assault on a gay person - I would hope it's clear it's not a hate crime, but regular assault. I suppose that's why they call them judges - too me it's a pure judgement call.

I still think having our government take up this issue is pure theatre for the masses. The frequency of this "hate" crime is so rare compared to other pressing issues - it's nearly as useless a waste of government time as baseball laws.
