As the article indicates, there are some interesting legal issues that may define new law. The key question is whether he is an insider given the facts and circumstances. If so, did he trade on material inside information?
I find it interesting as he has been so vociferous in opposing the NSS exposure, taking the approach of many who claim to out scams that NSS is really a minor issue and that it pales compared to penny stock scams. Given this part of his history, wouldn't you think he'd be so careful in his use of information, irrespective of what happens. He has to know he's under a microscope. The problem I've found with many of the so-called cybersleuths is that they ignore their own failings and hypocritically attack others at the drop of a hat, often twisting things to suit their agenda. Yet, when the tables are turned, they whine.

The big picture is probably as you suggest though and the publicity and fame are part of the reason for this case being in the news. Irrespective of my opinions on NSS and Cuban's comments, I like his "maverick" style and think we need more like him, and I can say that even though I probably disagree with his comments more often than not.
