I care that the honor of the court is maintained so that the separation of powers remains intact and according to principle. If the Supremes bend to the appeal of popular whim, they risk damages to the integrity of the court over time, as popular movements have a tendency to reverse themselves over time. The term, 'Activist Judge' has been applied to judges who go beyond their role to advance popular social movements. In addition sounding a horn to announce a candidate chosen to provoke conservatives because she is hispanic stinks of racism. She seems like a solid mainstream judge who is seen as liberal but not a wild eyed radical. I think that is a good choice without exaggerating any of her characteristics by calling her an 'activist' or by accentuating her ethnicity.
