I like ativist judges. IN the words of the great Earl Warren: it does not matter what the law is it matters what is just.

One problem with that idea is that it is a two edged sword. People can also override laws you like, or ignore constitutional principles you think are important, in the name of getting a decision they think is just.

Even if you have a majority of justices that broadly agree with you, do you really want to totally throw out the idea of the rule of law?
