It may be repugnant, but that doesn't make it false. The point is that equal treatment doesn't automatically equal fair or reasonable treatment. The legal principle only requires equal treatment, but we can pass laws that go beyond this minimal requirement, if not going beyond it would be unjust or unreasonable or repugnant.
