Its also a straw man. No one is claiming emotion is absent, only that emotion shouldn't drive a decision at odds with the actual law.

Primarily because the law isn't and probably can't be exactly clear in all situations. It will have a very clear meaning in many, and a fairly clear meaning in many more, but their are cases where the wording of the law is ambiguous, or where how the law in question applies to some new situation isn't clear.
