What system is that? Sotomayer is a year older than me. My law school class was 50 per cent women, and included so-called minorities. I graduated in 1980. That's a generation ago. Affirmative action has been around since the 1960's and has only been expanded. Sotomayer is a beneficiary, not a victim. Her problem is that she lacks credibility because of her past statements, which basically admit that she would not confine her analysis to the law, but would apply her own personal biases to her decisions. I find that problemmatical. It also shows---again---that there is nothing post-racial about Barack Obama. He is an avid player of the race and identity politics cards.
