There WAS a dissent, and it was a blistering one. The dissent is the only reason anyone was aware of this blunder.

Cabranes criticized Sotomayor and the majority for not explaining why they had sided with the city in their new opinion.


You have this habit of injecting info into a discussion without adequately explaining it.

First off, Cabranes was not part of the three judge panel. He was an independent judge who did not agree with the three judges conclusions on the Ricci case. Secondly, the panel didn't have to render an opinion. They simply chose to agree with the lower court's ruling. That's not that unusual. Thirdly, its important to point out that Cabranes is a conservative judge and that its conservative analysts who are having trouble with the judge's ruling on that case. That's not surprising since its conservatives who have trouble with affirmative action, racially discriminating testing etc.

In the meantime, the USSC is discussing the case. I am sure we will have their opinion before they recess for the summer.

Frankly, I don't like the way the City of New Haven dealt with this whole matter and I can understand why the white firefighters are pissed. At the same time, there is such a thing as racially/culturally biased testing. That issue can't be ignored either.
