The debt is a given. Chances are excellent if it wasn't for the government money, the dollars in play would have been far less.

Of course. The union and the two governments are going to have ongoing commitments to the new company. The other bondholders won't. Again, if they wanted more, they were free to make offers of their own. The judge has gone with this plan because he clearly thinks that more value will be preserved than by selling off the various pieces.

You have the same problem that i-node and Josef have. You haven't come up with any reason why the judge is going forward with this if it is illegal or even unusual. Granted, it is a little different than most bankruptcies, but the circumstances are more than a little different.
