"The court did not consider the merits of the Indiana case, deciding only that the full court would not hear the case." Actually, they went further than that. They decided that the plaintiffs hadn't managed to make their case for a stay. Besides, you haven't come up with a reason why a conservative leaning court would not take a case which violates the Constitution and normal business practices. If this settlement is as egregious as you are trying to make it, they would have given it a hearing. The fact of the matter is it isn't.
