What we are seeing here in So FL is the banks are willing to sign an agreement not to seek a deficiency judgement against the seller/defaulter. Sometimes the seller/defaulter will be asked to sign a note where they agree to pay maybe 1/10 or so of what they defaulted on. For instance saw one shortsale where the seller/defaulter had to sign a $24K note to the bank even though they got out of a couple hundred K in losses.
