Disparate impact is difficult to show. Who knows how many times the same test had been administered. How many persons of each race/gender took this test? On other occasions, what was the breakdown? Maybe the *minorities* on this occasion didn't study hard enough.

You can't just assume disparate impact, but that seems to be what the hiring authority did. They backed away from a disparate impact suit by engaging in disparate treatment. I don't find the outcome surprising.
