I doubt if there was fraud involved. Fraud implies an intent to deceive and it is far more likely this was an honest coding error.

Also, you didn't indicate whether the code involved was the ICD9 or the CPT and that would affect whether an improper reimbursement occurred.

At any rate, if such a mistake happens, the patient ought to report it as it becomes part of your chart which could have an effect on you down the road.
