When a law suit if filed, there is a process called discovery. This means that both sides have the right to obtain information from each other. Among the types of discovery allowed is the right to require your opponent to produce a document that they have or that is available to them. Also, as part of the discovery process the document could be supoenaed from the custodian.

I think the reason the Army changed its position and chose to reverse their order is because they understood that it was likely that this document would have to come to light.

What I don't understand is why those who filed other law suits were unable to get the documents. The courts in those cases must have limited discovery for some reason.
