I don't have enough information to answer that question. Generally they could have requested an order limiting discovery and if granted, it would have thwarted the plaintiffs. The problem with that is that it is hard for me to imagine the bases for an order limiting discovery. Of course Hawaii is a liberal state and may have liberal federal judges so the case may have turned on politics. lj
