AK law generally prohibits government employees from accepting gifts. Unlike federal law, it lacks a specific exemption for legal trusts.

The trust fund ethics issue seems to turn on the question of whether or not Palin has a degree of control over the trust. The Palin camp claims it's totally outside of her control. The opposition says otherwise, citing various evidence including the fact that the fund is run by her best friend Kristan Cole.

Keep in mind that the Personnel Board is Palin-friendly. The option for her to decline the trust fund money is a way to extract herself from this situation without a formal board ruling. The finding is dated July 14, so presumably it was sent to Palin on or around that date. Palin is resigning effective July 26, but she's still subject to the ethics law for two years after she leaves.
