I've heard the same stories, Murrey. But they don't aggregate well. I concede that lawsuits won is not the only item to be measured. But there should be some measurement of increased insurance costs and some judgment as to how much of that is insurance companies taking advantage of vulnerable doctors and how much is real. As for tests, I suspect that Obama's and Orzag's notion of a MedCap board would go some distance toward taking reliving doctors of that vulnerability. Though it's hard to tell.

My own take, fwiw, is that the proposed policy is still far too much of a moving target to get too worked up. Once we see something firm getting debated in one of the chambers, perhaps the House next week, we can start zeroing on what's missing. And what's right and wrong.
