In 1997 folks in my sales force had company cars. Headquartered in the northeast at the time, using a handheld cell phone while driving was and still is illegal, and our insurance company informed me that they required that we install a "hands-free" cradle in each car as a condition of insuring the fleet. If a company car was involved in an accident and the driver was using a hand held cellphone, they would not pay.

Driving while using a hand held cell phone is equivalent to driving drunk. I shutter to imagine the equivalent of driving while texting.

Bluetooth now negates the need for a "cradle", but the logic of a hands-free system (and especially a voice activated system) remains.
