Admittedly the legislative scheme is complicated but the language you are referring to amends the current medicare legislation and sets out the end of life counseling as a benefit that Medicare will cover and pay for. That is the reason for the detail. So in effect they are saying Medicare must offer and pay for this benefit. Like any other benefit medicare provides and must pay for the patient is not required to utilize the benefit.
