Defensive medicine and milking an asset are two different things. It's difficult to access because the same actions can be from either of the two motivations. If a Doc or hospital is trying to maximize profit dollars per patient (and I'm SURE that never crossed their minds </sarcasm>) then it's very easy to say "I was just practicing defensive medicine 'cause of the damn lawsuits".
