I'm trying to find my file on Geddes Res because there were, if I recall, some interesting points to consider which may be relevant to RKR. The bottom line was, for me, that Geddes probably would not have won in court as they could not establish that they had an interest in the property even though they had spent some $48 million in exploration. The mineral rights are owned by the Crown in BC, unless Crown granted. The surface rights were also owned by the Crown and were never granted to Geddes. In the case of a mine, the government usually sells the property to the mining comapny for a nominal amount so that it becomes private property owned by the mine. The mineral rights are always owned by the Crown (unless Crown Granted which they do not do anymore in BC and most other places in the world). The resolution of Geddes problem is what is interesting and as soon as I find my file, I'll share the legal research I did. I'm getting old and can't remember where anything is. One time recently, I dropped Jack off in the mall supposedly to pick him up in 2 minutes. I went home which is 35 minutes away. Completely forgot him! He died shortly thereafter but I don't think it was a related event.
BY the way Geddes property may be the largest VMS deposit in the world, larger than Kidd Creek.
