The problem, of course, is that those of us on the outside never know how much their decisions are determined by their profit motivation.

What on earth makes you think these companies would not be sued, AND LOSE, over something like this?

Insurance contracts are very specific as to what is and is not covered. If someone were damaged, or frankly, could even CLAIM damage, the insurance company which did this would be out of business.
