nhaynes, and neither will I sit and watch misinformation being posted to this thread by these supposed "do-gooders" that fantasize that they are "always championing people's rights" when they are in fact crippling them.
Are you so sadly mistaken and naiive that you actually believe that Arata doesn't need to be at least semi-studious with respect to patent application process? I will never cease to be amazed at the lengths that you will go to, to protect and smother the obvious. Key word here is "smother." Please be gracious and wise enough to let people grow up and be accountable. Arata doesn't need to dangle from your apron strings, and he doesn't need you to "save" him and "cover" for him and "make excuses" for him.
Arata et al has been so bold as to claim that he has filed provisional patent applications, and that there are patent pendings, --which again, indicates that a patent has been filed and is pending, and now you rush in and try to "cover" for him. This isn't parent teachers conference, nhaynes, this is the real world -- and it is ridiculous that you rush in and make excuses for his lack of knowledge in something that is so pertinent and vital to the world of discovery and invention. Granted, it is nice that a patent attorney has been hired, but this still doesn't excuse Arata from claiming to have filed provisional patents and claiming to patent pendings when such may have not been the case. Please don't misuse the concepts of "good business sense and practice" to your misconstrued contexts and portrayals.
Blatant Contradictions from September 23, 1997 press release: (Verbatim = word for word.)
1. "An agreement to market and sell AXEN has been finalized." By their own admission there is absolutely no guarantee that this product will ever be fully developed and brought to market. In their next breath -- after boldly announcing that an agreement had been made they say -- And I quote, "No agreements have been entered into and there can be no assurance that the company efforts in this regard will be successful." Does that not sound a little wishy washy, dizzy, confusing, and fickle?? Double messages?
2. "The company has patent pendings with respect to the two formulas for the product -- one for veterinary use and one for general use. Pardon me?? Now they announce at the salesmeeting that they have hired a patent attorney and it will take up to a year to get everything "worded" right... Well then why did they send false information to the newswires that there were "Patent Pendings" when and if they are in fact "planning on working on the wording of the patents" for a year or so...? Patent pending means that a patent application has been filed, and the information at the sales meeting declares that this is not so. This was false information that was disseminated.
3. "Arata, the inventor of the patented formulas..." Wrong again! There is no patented formula as of yet, so this is again false information that has been disseminated.
I am again amazed and amused at your post (and Randy's post), because you and Randy continue to live with the pie in the sky delusion that if you touch something and smell something and "feel" the consistency of something-- it is proof positive "magic potion." Did you take along your teams of microbiologists? Or did you just sit there with stars in your eyes and say "Wow, golly gee, it's fer real! It's fer real!" I am also disappointed that you again wasted precious time in belaboring your personality clashes with Derek, and I am very disappointed that you are turning your suspicion on him, when clearly, you should be turning a bit of healthy suspicion towards the "magic potion." You want to cripple Derek, for some reason, and I am truly disappointed that you don't seem to want to afford him his rights to post here. I champion his rights to post his opinions here, and I felt that his thoughts about Korpal being involved in the scam could very easily be interpreted as "opinion" and not "fact." I think that we all should kick back a little and not be so quick to jump the gun and jump to conclusions.
Korpal is a nurse, and unless YOU can prove otherwise, I stand by my assertion that Korpal shouldn't be portrayed as "being very intelligent within her field of Microbiology." Again there's some hassle between Fact and Opinion, and if you are going to assert that information in regards to Korpal's nursing education is erroneous, then the burdon of proof is on YOU to prove otherwise.
Lastly, I have absolutely nothing against NVID's new management, and I have absolutely nothing against Diana Korpal, but I do not know Diana's role and situation in it's entirety, so I have to withhold judgement. I, for the sake of the shareholders, hope that the magic potion is everything that you want it to be and more, and I reiterate that I will be the first to stand up and cheer Andrew Arata if the magic potion turns out to be "magical..."
