Rats. I thot this was slam dunk for Elan. But not a big deal, Elan can fix the breach. And nothing important has changed. I think the point that Elan can come up with the resources to buy out Ty in event of change of control at BGEN has been established here, regardless of the fine legal points on paper. Hope I'm not missing something important, don't think so...
