I have little doubt that under a single payer socialized healthcare system a malpractice reform would be inevitable, by default. There is no way the government would continue supporting 2 armies of lawyers (litigators AND defenders), along with the very expensive culture of defensive medicine. Lawyers don't know it yet, but they would be wise to diversify their business, if we get a "public option" in some form or another.

No socialized healthcare system in the world is very generous towards their respective medicolegal industries. Agreeing to throw lawyers under the bus ahead of time is no "concession" at all... it would happen anyway.
