There is nothing in the proposed legislation to have doctors working for the government. The plaintiff would still be suing a private party. If there were plans to socialize the practice of medicine rather than just the insurance aspect, and the doctor was part of the government, then I would understand how things might change and lawsuits become more difficult. As things stand or are proposed, I don't get it.

Again, what am I missing?


You are thinking in terms of what is in this iteration of the socialization. If they socialize the bureaucratic infrastructure how long will they wait to socialize the practitioners?

California tried this with energy and wingers tried to fool people into believing that it was not the stupidity of government intervention that caused the problem. (There are still a few daft people out there that don't understand it.)

You can't do a government takeover of healthcare bureaucracy without necessarily taking over the medical practices too. After a few sacrificial lambs get bankrupted by the regulation of earnings with unlimited liability doctors will refuse to provide medical care.

The sane realization that the takeover caused the problem will never cross a liberal pol's lips. They will then have to take over medical practices next to keep doctors from completely refusing to provide any care.

Sometimes you have to think in terms of the downstream impact of initial steps.
