So the arguments about lack of competition may be not so solid as they had seemed, but even if they are/were solid, my response would be to get rid of the laws and regulations that reduce competition, rather then leaving that one set of distortions in place, and then adding a new one to try to balance it. The most obviously relevant restrictions would be the restrictions against interstate insurance sales, but I'm sure there are others as well.
