You can still have state regulation. You'd want some regulation. Just make the states compete as Tim says by allowing national policies with exceptions rather than totally different policies. The states that insist that every policy must include coverage for acupuncture will back off and cut out the frills. They will decide what is really important and set that limited set up as exceptions. Meanwhile insurance companies will have settled on a selection of baseline policies which will include the key protections that any state or federal regulation would necessarily have. Then the individual picks from the baseline policy offerings, the insurance company tacks on the state-determined exceptions, and you're good to go.
