This is so common

I hear it all the time in the scams I've followed. "if this were such an obvious scam, the SEC would have shut it down by now".

And that has real power. When scam allegations are out there....and the company still trades....and the company still REPORTS to the SEC.....that gives, in a lot of penny investors minds, and air of legitimacy if not an implicit stamp of SEC approval.
