I don't understand your point of view at all. Obviously you believe in God, so that is not the issue. There are many things that we could do absent human interference, these are referred by the founders as natural rights.

For example a person cannot have the right to free health care granted to him by the government, because to do so would be to force another person to provide that "right". On the other hand whether or not the government recognized free speech, it is still a "natural right". It is something you have the right to do that can only be taken from you by force.

If God can confer free will, why not free speech.
