On September 30, 2009, CombiMatrix Corporation (“CombiMatrix” or the “Company”) entered into a supply agreement (the “Supply Agreement”) with Illumina, Inc., a provider of systems for the analysis of genetic variation and biological function (“Illumina”). Pursuant to the Supply Agreement, CombiMatrix has agreed to sell to Illumina and its affiliates certain CombiMatrix products for use in or for sale with Illumina products and applications. Subject to certain minimum purchase order commitments, the Supply Agreement also gives Illumina an option to purchase exclusive rights to use and sell those CombiMatrix products in a designated field.
