You guess wrong. The FTC and the DOJ operate entirely differently than the EU Commission. Both paths provide a full range of due process procedures available to the defendant.

The FTC conducts an investigation and may issue a Complaint that will result in an administrative hearing before an Administrative law Judge (ALJ). The administrative hearing is much like a court proceeding with witness testimony, cross examination and documents and uses rules of evidence. An opinion by the ALJ follows and then a final decision by the FTC.

The DOJ conducts an investigation and may file a Complaint in US District Court. Discovery follows and then a civil trial may be held.

The FTC and the DOJ split coverage of antitrust investigations, generally by agreement. The FTC covers Intel and the DOJ covers Microsoft.
