Anthony - PMFJI,

<<Can John purchase another x shares of Wind at the current price of $37 and at the same time sell his other x share of Wind at $37 (purchased at $47) that he currently has a so he can avoid the 30 days rule?>>

Not at the _same_ time, but if a double position is held long enough to cover the wash sale period and the original shares are the ones explicitly specified to be sold, it works out OK.

1. Buy new x shares in mid November
2. Sell original x shares (specified to broker) in late December.
3. Risk is period of double exposure (and loss might turn into a gain -g-)

Regards, Don
